VILLAGE OF BARODA Council Minutes Baroda Municipal Building July 6, 20096:30 p.m.
Members Present: President Bob Getz, Trustees Claudia Brister, Larry Nye, Ed Rath, Milt Sluder and Don Turney, Treasurer Amy Hemhill and Clerk Mensinger.
Members Absent: Trustee Mona Stankiewicz
Guests: State Rep. Sharon Tyler, Cindy LaGrow, Rodney Nitz, Jim Florian, Rev. Chris Noffke, David Wolfe and Pastor Kendall Holder
Meeting called to order at 6:30 p.m. by President Getz. Meeting opened with the Pledge of Allegiance. I. Audience Comments – none
II. Reports A. Police Chief – The Chief is out of town – see written report on file. B. Village Engineer – No report. C. Committees 1. Park – Larry Nye – Nothing to report. 2. Finance – Treasurer Hemphill a. One of our CD’s matures tomorrow and Treasurer Hemphill will reinvest. b. The first quarter year-to-date budget is on file in the Clerk’s Office. D. Planning Commission – Ed Rath – Nothing to report.
III. Unfinished Business A. Maintenance Building Gate President Getz clarified that we had previously approved having Maintenance Director Krone repair the gate for $300. B. Mower Purchase Motion by Ed Rath, seconded by Larry Nye to purchase the Grasshopper mower from Baroda Township in the amount of $2,500. Motion carried, no nays. C. Music in the Park Update Clerk Mensinger reported that there were between 75 and 80 people in attendance at the June Music in the Park. The next event is July 26 with the Ed Bagatini Jazz Quartet. D. Safety Day Update Clerk Mensinger reported that she met with Suzann Flowers from the Southwest Michigan Planning Commission regarding the upcoming Safety Day on October 11. Ms. Flowers will provide all of the volunteers for the Bike Rodeo and Clerk Mensinger will coordinate the other activities. E. Miscellaneous – None
IV. New Business A. Liquor License Control Commission Resolution 2009-2010 - #4 Motion by Milt Sluder, seconded by Claudia Brister to approve the Liquor License Control Commission Resolution 2009-2010 - #4. Tool & Die Recovery Zone Resolution 2009-2010 - #5 & #6 Cindy LaGrow of LaGrow Consulting was present to request that the Council approve a 5-Year Renaissance Recovery Zone to Midwest Die and to Quality Mold & Engineering. It was noted that Midwest Die had requested this status before but was denied. Motion by Larry Nye, supported by Don Turney to approve the Resolution 2009-2010-#5 requesting a Renaissance Recovery Zone to Midwest Die. Sign Ordinance Motion by Ed Rath, seconded by Milt Sluder to adopt the Sign Ordinance Amendment No. 166 to take effect 8 days after publication. Electrical Inspector Fees Clerk Mensinger provided a sample agreement that would set all of the inspectors’ reimbursement portion of permit fees at 85%. Currently the Building Inspector receives 85% of all permit fees, the Plumbing and Mechanical Inspector received 80% of all permit fees and we have not set an amount for the newly appointed Electrical Inspector. President Getz recommended that all inspectors receive the same amount. Motion by Larry Nye, seconded by Don Turney to set all inspectors reimbursement at 85% of all permits. Motion carried, no nays. E. Township Trash Ordinance Baroda Township Trustee David Wolf made a presentation on the current rubbish tax and on a proposed ordinance to change how rubbish fees are collected. Currently, the taxpayers are not being treated equal in that the rubbish tax is based on a property’s SEV. The proposed ordinance will be based on a per container basis. In order for the Township to pass their ordinance, the Village must pass the same ordinance and an intergovernmental agreement must be created. The Township will administer the program. Most Village residents will see a slight increase in their rubbish payment. Council agreed to send the materials to our attorney for his review before agreeing to pass the ordinance. This item will be tabled until our attorney can review and we come to a consensus on the ordinance. F. Charitable Gaming License Resolution 2009-2010 - #7 Barodafest has applied for a gaming license to run a raffle at the festival. One of the requirements is to have the local government pass a resolution to provide the disbursement of funds if Barodafest should disband. Motion by Milt Sluder, seconded by Ed Rath to approve Resolution 2009-2010-#7 Charitable Gaming License. Treasurer’s Report C. Paying of Bills and Transfers - $26828.54 D. Correspondence Motion by Ed Rath, seconded by Claudia Brister to approve the consent agenda items. Motion carried, no nays. VI. Council Comments A. President Comments 1. Bridge Inspections – Oscar Loveless from Wightman & Associates, Inc. called to report that bridge inspections are due next year and that the cost will increase. President Getz also reported that we need to develop a Scour Plan. 2. Revenue Sharing – The MML has sent several notices that the State has been back and forth on cutting next year’s Revenue Sharing. They have not come to a final consensus yet. 3. Clerk Reception – President Getz stated that a reception for Clerk Mensinger winning the MAMC 2009 Village Clerk of the Year Award will be held on Monday, August 3 at 6:00 p.m. 4. President Getz stated that he will be on vacation July 17 – 26 but is available by cell phone if needed. 5. President Getz thanked Pastor Holder and Baroda Church of God for mowing several lawns in the Village. 6. Pipeline Damage – President Getz reported that the Maintenance Dept. broke a gas Pipeline on June 4 while repairing a catch basin. The repair bill from Michigan Gas Utilities was $1,506.23. The Maintenance Director did not call Miss Dig prior to beginning work on the basin. B. Council Member’s Comments 1. No comments from Clerk Mensinger, Trustee Sluder and Trustee Brister. 2. Trustee Turney stated that the sidewalk and street repair on First Street looks good. He questioned when the drain and manhole at the corner of First and Church was going to be repaired. Trustee Nye stated that the entire storm drain has collapsed and we are waiting until we do the streetscape to repair it. 3. Trustee Nye stated that there are several unlicensed vehicles on Cornelia Drive and a home with the roof torn off from several years ago that has never been finished. There is also another home with a lot of junk lined up on the driveway. He also feels that the Village Maintenance Building lot needs to be cleaned up. The old street sweeper is still in the lot – it was supposed to have been sold for scrap metal. He also questioned if the old fire truck was worth keeping – Clerk Mensinger will check with Mr. Krone. 4. Trustee Rath stated there are two properties with vacant land in the Village that needs to be mowed. 5. Treasurer Hemphill stated that she will be on vacation July 12 – 19.
