Members Present: President Bob Getz, Claudia Brister, Larry Nye, Ed Rath, Milt Sluder, Mona Stankiewicz, Don Turney, Treasurer Hemphill and Clerk Mensinger

Meeting called to order at 6:30 p.m. by President Getz. Meeting opened with the Pledge of Allegiance.

Motion by Ed Rath, seconded Milt Sluder to approve the consent agenda items. Motion carried, no nays.

A.  Police Chief – no report

C.  Committees

1.   Park – Trustee Nye

A workday was held on Saturday, April 25 and on Wednesday, April 28 with volunteers from Fairmont Minerals. There is still work to be completed and volunteers are needed.

2.   Finance – Treasurer Hemphill

The audit is complete and Bob Gerbel will do his review at the June Council meeting. The 2008-2009 Budget has been updated per the audit.

D.  Planning Commission

      1.   A public hearing will be held on 5/19/09 to discuss the rezoning request of

property at 9395 Cleveland Ave from R-2 to Ag.

2.   Sign Ordinance -  Due to a miscommunication, the public hearing to review the sign ordinance will be held in June.

E.  DDA – nothing to report

 

IV.       Unfinished Business

A.  South Shore Tool & Die / Pratt

We received the opinion letter from Wightman & Associates, Inc. regarding the chemicals used at South Shore Tool & Die. They feel that the safety plan and chemicals used are allowable and will not affect the sewer system or the ecology of Hickory Creek.

      Motion by Don Turney, seconded by Larry Nye to allow South Shore Tool & Die to maintain the floor drain per

      the recommendation from Wightman & Associates, Inc.

      Motion carried, no nays.

B.  Business of the Year Awards

Clerk Mensinger suggested that we add John Baird, owner of Baroda Estates and Mini Storage, as our Community Spirit recipient as he donates his time to do the information technology for the Township and Village. He also donates the use of a storage unit to the Miss Baroda Committee and contributes to community events. The Council consensus was to give him this award.

C.  Sewer Pond Resurfacing

Tabled due to lack of detailed quotes. Clerk Mensinger will speak with Maint. Supervisor Krone and will gather more information.

D.  Sewer Fence

Tabled until we can can confirm pricing and ask for a quote on moving the fence in six feet.

E.   Pet Waste Disposal System

 Motion by Ed Rath, seconded by Milt Sluder to purchase a Mutt Mitt Kit for the  

 Village Park.

 Motion carried, no nays.

F.  Miscellaneous – Nothing further to discuss.

 

V.        New Business

A.  Public Hearing Reimbursement Policy

Clerk Mensinger presented a proposed reimbursement policy to collect fees from a public hearing. Trustee Rath suggested that the policy be sent to the attorney for approval before we adopt the policy.

B.  Miscellaneous

Village Elections - Clerk Mensinger announced that Village elections will be held on Tuesday, September 15, 2009. Positions to be voted on are President for a 2-year term and three trustees for 4-year terms. Petitions and Affidavit of Identities are due June 23, 2009.

 

 VI.      Council Comments

A.  President Comments

      1.   President Getz announced that Clerk Mensinger has been nominated for the Michigan Association of Municipal

            Clerks Village Clerk of the Year Award. If she wins it will be presented at the MAMC Conference in June.

      2.   President Getz read a thank you from the Hemphill family.

      3.   Berrien County Road Commission Pavement Marking Program

Motion by Milt Sluder, seconded by Mona Stankiewicz to contract the Berrien County Road Commission to    

do the pavement marking.

Motion carried, no nays.

      4.   Maint. Supervisor Krone has asked for authorization to hire Kathy Krone on an as needed basis for mowing at 

            the sewer ponds when community service workers are not available.

Motion by Don Turney, seconded by Claudia Brister to hire Kathy Krone on an as needed basis for mowing at the sewer ponds at $8 per hour.

Motion carried, no nays.

      5.   Affluent Waste

A few months ago when we had a winery interested in locating in the Village, Wightman’s looked into the    

affects of winery waste on the sewer system. Wightman’s recommended that if a lot of wine was being made,    

the winery would need to put a filter on their system to prevent problems with our sewer system. Founder’s

Winery has located in the Village and is producing wine, however they are purchasing filtered juice so it will not

affect the sewer system.

      6.   Mr. Bavido inquired if the Village would consider renting his building as a Welcome Center during the summer   

            months. Council consensus was to decline his offer. However, he did consent to allowing us to make a display   

            in his front window if we  remove the tinted film. Clerk Mensinger was looking into having posters made from

            historical pictures to create a point of interest on First Street. She will present more information at the next

            Council meeting.

 

B.  Council Member’s Comments

      1.   Clerk Mensinger stated that she will be out of the office Wednesday through Friday of this week. The answering

            machine will be updated for this time period.

      2.   No comments from Trustees Brister and Stankiewicz.

      3.   Trustee Sluder thanked Pastor Holder and Larry Litke from Baroda Church of God for volunteering to clean up

            yards and do various work around the Village as part of the church’s outreach program.

      4.   Trustee Nye

a.   Trustee Nye asked if the Enforcement Officer had contacted a resident regarding the trash at the residence.

      Clerk Mensinger will contact the Village Enforcement Officer.

                        b.   The second issue he inquired about was if Dr. Shire had been contacted about removing the torn awning off

                              the front of the building he owns. President Getz stated that a letter has been sent with a deadline of May 15

                              for the removal of the awning.

      5.   Trustee Turney stated that the two tractors located on the corner of Lemon Creek Road and Cleveland Avenue

            have been moved, however, two trailers remain. He also stated that the old tires are still stacked behind

            Baroda Tire Center.

      6.   Trustee Rath asked if the Drain Commission was supposed to clean out the Starr & Wellington Drain when

            they installed the addition along Ruggles Road. The consensus was that yes they had agreed to that. Clerk    

            Mensinger will follow-up with the Drain Commission.
