VILLAGE OF BARODA Council Minutes Baroda Municipal Building November 2, 20096:30 p.m.
Members Present: President Bob Getz, Trustees Claudia Brister, Larry Nye, Ed Rath, Milt Sluder, Mona Stankiewicz, Don Turney, Treasurer Amy Hemphill and Clerk Mensinger
Guests: Leonard Krone, Pastor Holder
Meeting called to order at 6:32 p.m. by President Getz. Meeting opened with the Pledge of Allegiance.
I. Audience Comments – none II. Reports A. Police Chief – No report was given other than President Getz stated that the drug dog has brought in $106,000 since October 6th. B. Village Engineer 1. Hills Rd/Streetscape - Authorization Request by President Getz Motion by Don Turney, seconded by Milt Sluder to authorize President Getz to sign paperwork for the State of Michigan in order to proceed with the Hills Rd/First Street Project. Motion carried, no nays. 2. Founders Drain a. Maint. Supervisor Krone stated that Founders Wine Cellar had installed clean outs connected into our sewer without permission. He made them cap the lines off. The floor drains in that building have always run off into Hickory Creek. b. The Department of Agriculture has inspected Founders Wine Cellar and had determined that they have not met all of the specifications. c. Clerk Mensinger stated that she received several phone calls for Durwood D’Agostino because Founders Wine Cellar had Hollerbach do some excavating and pushed dirt on to his property and wanted it removed. They were told that it was not a village issue and that they needed to contact Founders directly to request the dirt be moved. C. Committees 1. Park – Larry Nye - nothing to report 2. Finance – Treasurer Hemhill a. Sewer Special Assessments and Interest on Special Assessments collected through the 2009 Summer Taxes have now been moved from the tax collection account to the proper accounts. b. Budget Amendments – Treasurer Hemphill reported that we had to create a new account for the Capital Projects funds. Motion by Ed Rath, seconded by Don Turney to approve the budget amendments as presented. Motion carried, no nays. c. The CPI figures have been released for the coming year. Last year it went up (4.4%) and this year it went down to -.3%. This will effect taxable value and be a factor in our millage calculations for next year. D. Planning Commission - Ed Rath reported that the Planning Commission has begun working on the Industrial Park Declaration of Conditions, Covenants, Restrictions and Reservations document and should be able to present a final document at the December council meeting.
III. Unfinished Business A. Revolving Loan Fund – President Getz - We have received two preliminary applications and are waiting on a third one. When that application is received we will have the RLF Committee meet to review and prioritize the applications/ B. Hickory Creek Washout – Maint. Supervisor Krone - Maint. Supervisor Krone reported that they have not completed the work this year, but will need to wait until spring because Hickory Creek is a designated trout stream and the salmon are spawning now C. Barodafest Insurance – Clerk Mensinger - Clerk Mensinger reported that the Barodafest Committee has received a quote for liability insurance and will have a meeting on November 5th to determine how they will proceed and will report back to Council at the December council meeting. D. Miscellaneous – none
IV. New Business A. Snow Plowing – Maint. Supervisor Krone 1. Motion by Larry Nye, seconded by Milt Sluder that all Municipal Building expenses be split three ways (including snow plowing and lawn care) and that the Fire Station snow plowing will be paid in full by the Township. Motion carried. 2. Leaf Pick Up - Maint. Supervisor reported that by using the two Township workers, the expense of picking up leaves in the limited Township area is within $300 of being a wash. B. Community Service Workers – Clerk Mensinger - Clerk Mensinger reported that the Risk Management Division has reported that our insurance does not cover Community Service Workers. The Volunteer Center stated that court ordered community service workers are only covered for minor things such as bee stings and poison ivy. Motion by Ed Rath, seconded by Bob Getz to stop using community service workers unless the court provided 100% liability insurance covered for the workers. Motion carried, no nays. C. Miscellaneous 1. SEMS – tabled until Maint. Supervisor has obtained more information. 2. Pheasant Run Standing Water Mr. Gollnast had called Maint. Supervisor Krone regarding the standing water in his driveway due to the lack of a drainage system on Pheasant Run. Trustee Sluder pointed out that we had over two inches of rain on Oct. 30 (day the complaint was made) and that the water did recede the same day. Trustee Sluder suggested that Mr. Gollnast petition the drain commission to have a drain installed. Maint. Supervisor Krone agreed to contact the Drain Commission to discuss the options. 3. Music in the Park – Clerk Mensinger - Clerk Mensinger requested permission to book the entertainment for 2010 Music in the Park Concert series. Council consensus was to continue with this program. 4. Effective Workshop Meeting – Clerk Mensinger - Lincoln Township has asked to partner with Baroda Village and Township to bring Julie Pioch, VB County MSU Extension Director, to present a workshop on how to run an effective meeting, etc. on November 30. This is open to all boards of the municipalities. Clerk Mensinger asked that reservations be turned in by November 18th. 5. Award Announcement – Clerk Mensinger - Clerk Mensinger announced that Maint. Supervisor Krone has received the Edward Dunbar Rich Service Award from the Michigan DEQ for over 25 years of service to running the Water Department. 6. Handouts – Clerk Mensinger - Clerk Mensinger provided handouts on how to use a consent agenda and how to properly make motions, ordinances and resolutions. She requested that Council members review the handouts prior to the December council meeting and we would discuss them at that time.

VI. Council Comments A. President Comments - The MEDC will be reviewing our survey results for certification of the low-mod income survey. B. Council Member’s Comments 1. No comment from Trustees Brister, Rath, Sluder, Stankiewicz and Turney, Clerk Mensinger or Treasurer Hemphill. 2. Trustee Nye stated that the Founders Wine Cellar is bringing in quite a few bus tours into the village. We may need to consider purchasing land for additional parking and a new water tower.
