Council Minutes

Baroda Municipal Building

September 8, 2009

6:30 p.m.

Members Present: Bob Getz, Larry Nye, Milt Sluder, Mona Stankiewicz, Don Turney, Treasurer Hemphill and Clerk Mensinger.

Members Absent: Claudia Brister

Guests Present: Mr. & Mrs. Hunt, Mr. & Mrs. Hoadley, Pastor Holder, Joanne Whitehead, Josh Whitehead, Dave Wolf, Steve Carlisle.

Meeting called to order by President Getz at 6:31 p.m. Meeting opened with the Pledge of Allegiance.

I.      Audience Comments

        The Hoadley’s and Hunt’s were present to inquire about the status of the Whitehead’s garage loft living quarters. President Getz stated    

        that the court ordered disconnects had been completed and inspected by the Building Inspector. They also stated that there are a lot of   

        dogs running loose in the neighborhood; President Getz told them to call Animal Control when they see the dogs. Mr. Hoadley also

        inquired what is the ordinance regarding fire pits. President Getz stated that recreational fires are allowed as long as they are in a fire pit.

II.     Reports

        A.  Police Chief - Chief Ruhl submitted a written report stating that Office Hopkins and the drug dog will begin patrolling on October

              6th.

        B.  Village Engineer – Steve Carlisle

              1.   Hills Road and First Street Streetscape - Mr. Carlisle stated that we need to determine how to handle the intersection at Hills

                    Road and First Street. We are also adding a sidewalk to connect First Street to Sonoma Court. The MEDC is sounding very

                    favorable if we are declared a low to moderate income community. It was a consensus to have bump outs at the First St./Hills

                    Rd. intersection and the First St./Lemon Creek Rd. intersection.

Trustee Sluder left the council meeting at 7:15 p.m.

              2.  Hickory Creek - Mr. Carlisle stated that Maint. Supervisor has consulted with Drain Commissioner Zilke regarding the bank

                   erosion and it was decided that we will do the work ourselves to dig out the sediment and grade the bank back.

 

        C.  Committees

              1.  Park – Larry Nye - Trustee Nye reported that he has been fertilizing the trees and we may lose a maple tree. The flowers around

                   the gazebo need to be thinned out and replanted.

              2.  Finance – Treasurer Hemphill

                   a. Tax collection to date is $58,000 with an outstanding balance of $130,840.

                   b. We received our salt contract through MI Deal – salt is $59.48 per ton.

                   c. The County is holding a property foreclosure land auction on 9/15/09 with beginning bids of $50.

        D.  Planning Commission – Ed Rath - Nothing to report. President Getz stated that the Planning Commission will begin working on

              developing guidelines for buildings in the industrial park.

 

III.   Unfinished Business

        A.  Music in the Park Update – Clerk Mensinger - There were approximately 90 people in attendance for UpHill Climb. Clerk     

              Mensinger will begin booking next year’s entertainment after Barodafest.

        B.  Trash Ordinance & Intergovernmental Agreement Update

              1.  Motion by Ed Rath, seconded by Don Turney to adopt Ordinance 167 - Garbage Collection and Disposal. Motion carried.

              2.  Motion by Ed Rath, seconded by Don Turney to adopt the Intergovernmental Agreement with Baroda Township concerning

                   Garbage Collection and Disposal. Motion carried.

              3.  Township Trustee Dave Wolf stated that the next step is for the Baroda Township Board to pass a resolution setting the garbage  

                   collection rate at their 9/21/09 meeting.

        C.  CDBG Survey – President Getz - The results of the surveys returned to date show that the Village is at a 66% low to moderate

              income level. We need four more surveys to have enough collected to be able to apply for the $650,000 Community Development

              Block Grant for a streetscape project.

        D.  Drain at First/Church Sts. - Clerk Mensinger reported that the Maintenance Department has repaired the drain at the corner of First

              and Church Streets.

        E.  Park Light – President Getz -It was a consensus to table this item until the next fiscal year.

        F.  Hole in street at Alley/Bill’s Tap - Clerk Mensinger reported that the Maintenance Department has repaired the hole in the alley

              behind Bill’s Tap.

        G.  RDA Revolving Loan – President Getz - State Representative Sharon Tyler issued an announcement that the Village has received

              approval for a $50,000 RDA Grant to set up a Revolving Loan Fund. Clerk Mensinger stated that there were two additional        

              businesses that expressed interest in applying for a loan.

        H.  Miscellaneous

             Christmas in the Park – Clerk Mensinger

             Clerk Mensinger expressed that due to a possible upcoming surgery that she would not be able to take the leadership role for    

             organizing Christmas in the Park this year and asked Council Members to consider taking it over. Nobody from Council would

             commit to taking over the leadership of this event so it has been cancelled for this year.

 

IV.   New Business

        A. Schultz Water Bill – Clerk Mensinger - Doreen Schultz has been working with the Department of Human Services to get help paying

             her water bill. Clerk Mensinger has even contacted Representative Tyler’s office and Senator Ron Jelinek’s office to try and get Mrs.

             Schultz some assistance. DHS has helped several people in the Village with water bills in the past but are now stating that they don’t

             help with water bills. In the meantime, Mrs. Schultz has been acquiring late fees. She has paid on the account when she could, but is

             asking that we consider waiving some of the late fees. Motion by Larry Nye, seconded by Bob Getz to waive the late fees in the        

             amount of $82.27 leaving her a balance of $119.62. Motion carried, no nays. Pastor Holder from Baroda Church of God announced

             that the church would pay the balance of her account.

        B.  Flu Shot Clinic – Clerk Mensinger - We are not able to partner with the Parish Nurse Program this year for flu shots, but are able to

             sponsor a clinic for a site fee of $30 which would be split between the Village, Township and Police Department. It was a consensus  

             to offer this as a community service. The date will be October 13 from 3:30 – 5:00 p.m.

        C. Trick or Treat Hours – 10/31/2009 – 5:30 – 7:00 p.m. Motion by Ed Rath, seconded by Mona Stankiewicz to hold trick or treat

             from 5:30 – 7:00 p.m. on October 31st. Motion carried, no nays.

        D. Miscellaneous

            1. Municipal Code Corporation has submitted a bill for $350 to continue to maintain our Ordinance Book on line. Motion by Don    

                Turney, seconded by Mona Stankiewicz to renew our online service with Municipal Code Corporation. Motion carried, no nays.

            2. Office Hours - Clerk Mensinger announced what her new office hours will be and will post them for the public. Monday, Tuesday

                and Thursday will remain 9 a.m. to 12 noon and 1 p.m. to 5 p.m., Wednesday from 12 noon to 5 p.m. and Friday 9 a.m. to 12

                noon.

        Motion by Ed Rath, seconded by Larry Nye to approve the consent agenda items. Motion carried, no nays.

 

VI.  Council Comments

       A.  President Comments

            1. Commercial Tax Abatement legislation is being introduced by Representative Tyler soon.

            2. President Getz will be on vacation from September 18 through 26 but will be available via cell phone.

       B.  Council Member’s Comments

            1. Clerk Mensinger announced that she will be on vacation September 26 through October 7.

            2. Don Turney

                a. Expressed appreciation to the Maintenance Department for their hard work in maintaining the streets.

                b. Expressed appreciation to the guests present at the meeting as the Council appreciates resident’s input.

            3. Treasurer Hemphill stated that her hours were changing again with the start of school. She will now work Tuesday and Thursdays

                from 9 a.m. to 4 p.m. and possibly one-half of a day on either Monday or Friday.

            4. No comments from Trustees Stankiewicz, Nye and Rath.
